Q-1031 Process

Step 1

Select a Trusted Qualified Intermediary

To qualify for a 1031 exchange, the funds must be held by a qualified intermediary, such as e1031xchange, and an exchange agreement must be signed.

Step 2

Create Your 1031 Plan

When starting your 1031 exchange, it is important to have a backup plan if it fails. If your Qualified Intermediary does not do this, please contact us. We offer dozens of 1031 safety net options to ensure you are not paying any capital gains tax.

Step 3

Sell Existing Property

The property sold is the “relinquished property.” All deadlines start from the closing date of the relinquished property (the contract date does not matter).

Step 4

Identify Replacement Property

This is important. There are 3 options to identify potential properties to buy (the “replacement” properties), but this must be done within 45 days and in writing to e1031xchange.

Step 5

Complete Purchase of New Property

Finally, the closing of the replacement property must happen within 180 days of the closing of the relinquished property, and it must be one of the properties you have identified. If you can not get the property in time, you fall into one of the safety net options you selected.

Redler has also served as a Legislative Assistant to the Honorable Richard A. Gephardt, Majority Leader, U.S. House of Representatives, and was Systems Engineer for EDS/GM in Detroit Michigan, in addition to being a talk-radio host. He earned his B.S./B.A degree from the University of Missouri, Columbia and his J.D. degree from the Washington University School of Law.

He has earned the prestigious designation of Trust and Estate Practitioner (TEP) from the Society of Trust and Estate Planners (STEP) where he serves on the Board of Directors for the Orange County California chapter.
